Terms of Service for OWS InfoTech

Welcome to OWS InfoTech! These Terms of Service ("Terms") govern your access to and use of our website, IT products, services, consulting, and corporate training (collectively, the "Services"). Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms.

• User Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Services. If you are using the Services on behalf of a business, you represent and warrant that you have the authority to bind such business to these Terms.

• Use of Services

You may use the Services only for their intended purposes and in accordance with these Terms and any applicable laws and regulations. You may not use the Services for any illegal or unauthorized purpose, including but not limited to:

• Infringing on any intellectual property rights of others.
• Transmitting any harmful or malicious content.
• Interfering with or disrupting the Services.
• Attempting to gain unauthorized access to the Services.

• User Content

You are responsible for any content you submit to the Services ("User Content"). You represent and warrant that you own all rights to the User Content or have obtained all necessary permissions to use and submit it. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display your User Content in connection with the Services.

• Intellectual Property

The Services and all content within them are protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, distribute, transmit, display, publish, sell, license, or create derivative works of any content within the Services without our express written permission.

• Termination

We may terminate your access to the Services at any time without notice for any reason, including but not limited to:

• Violation of these Terms.
• Misuse of the Services.
• Non-payment of fees.
• Inactivity for an extended period.

• Disclaimer of Warranties

The Services are provided "as is" and without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and data accuracy. We do not warrant that the Services will be uninterrupted, error-free, or secure.

• Limitation of Liability

We will not be liable for any damages arising out of your use of the Services, including but not limited to:

• Direct, indirect, incidental, consequential, and punitive damages.
• Loss of profits or revenue.
• Loss of data.
• Personal injury or property damage.

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and costs (including attorneys' fees) arising out of your use of the Services or your violation of these Terms.

• Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the Telangana State in India without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of the State of Telangana, India.

• Amendments

We may amend these Terms at any time by posting the amended Terms on the Services. The amended Terms will be effective immediately upon posting. You are responsible for reviewing the Terms regularly. Your continued use of the Services after the posting of amended Terms constitutes your acceptance of such amendments.

•  Payment Terms for IT Products and Services

1. • General:
     1. These payment terms apply to all purchases of IT products and services provided by OWS InfoTech
     2. All prices are quoted in US Dollars [$] unless otherwise stated.
     3. Invoices will be issued electronically and emailed to the email address provided by the customer.

1. • Payment Methods:
     1. We accept payments via credit card, debit card, bank transfer, and PayPal only.
     2. Payment is due upon receipt of invoice unless otherwise agreed in writing.

1. • Payment for Products or Services:
     1. Payment for software licenses and other digital products is due in full at the time of purchase.
     2. Payment for consulting, training, and other services is due in advance while placing the order.
     3. Payment for hardware, accessories, and other tangible products is due in advance while placing the order plus a delivery fee will apply as per our approved shipping providers.
     4. Strictly there will be no refunds will be issued for any product or services.

1. • Payment for Services:
     1. Services may be billed hourly, project-based, or through prepaid retainer agreements.
     2. Hourly rates will be clearly communicated in advance and invoiced daily/weekly/monthly as agreed in the contract.
     3. Project-based services will be invoiced according to the agreed-upon project milestones.
     4. Retainer agreements will require a prepayment of a portion of the expected service fees, with remaining fees invoiced based on usage.
     5. For any service orders, a minimum of 25% of the non-refundable amount should be paid in advance.

1. •  Late Payments:
     1. A late payment fee of 3% per month will be applied to any outstanding invoice balance after 15 days.
     2. We reserve the right to suspend or terminate services for any account with outstanding invoices exceeding 30 days.

1. • Refunds:
     1. We strictly follow a no-refund policy but only except in case if specifically mentioned on the agreement otherwise no refund will be entertained for any of our product or service whether digital or tangible.
     2. We offer a 7day money-back guarantee for [Specific products or services eligible for refunds as mentioned on the signed agreement].
     3. Refunds will be issued only upon return of the purchased product or cancellation of the service agreement.
     4. Refunds will be issued to the original payment method used for the purchase.

1. • Taxes:
     1. Any applicable taxes are not included in the quoted prices and will be added to the invoice. GST as applicable.
     2. Customers are responsible for verifying and paying any applicable taxes based on their location.

1. • Dispute Resolution:
     1. Any dispute arising from these payment terms will be subject to [Dispute resolution method, e.g., arbitration, mediation]. Of District/High Court of Telangana.
